Anderson and Anderton Speaking at TEI Regions IX & X Tax Conference in Arizona

Tax Executives Institute (TEI) is the preeminent association for in-house tax professionals worldwide. The TEI Regions IX & X Tax Conference will take place June 11-13, 2018 at the Westin Kierland Resort in Scottsdale, Arizona. Andersen Managing Directors, Eric Anderson and Dave Anderton, will present at the conference. Their presentation is on "State Response to TJCA (Tax Cuts and Jobs Act)."

Our federalist system of government provides state and local jurisdictions the authority to impose state taxes independent of federal income tax. Most states that impose an income tax follow the federal determination of taxable income, but the states are not compelled to adopt the entire Internal Revenue Code. The resulting lack of uniformity creates a patchwork of different rules among the various states. This lack of uniformity is exacerbated by the recently enacted U.S. tax reform. States that adopt the most recent version of the Internal Revenue Code may enact specific disconforming provisions, while other states that do not adopt the current Internal Revenue Code may or may not enact conforming or partially conforming provisions.

The presentation will provide an overview of significant tax reform legislation and the varied state responses. The presentation will also explore areas of uncertainty related to Subpart F income, Global Low Taxed Intangible Income, and dividends received from controlled foreign corporations. In addition, the session will explore unique state issues surrounding apportionment of income items resulting from tax reform and the potential impact of the Supreme Court’s imminent decision in Wayfair v. South Dakota.   

Eric Anderson leads the San Francisco Bay Area state and local tax practice of Andersen. He focuses on income tax planning and compliance, sales and use tax transaction planning, mergers and acquisitions, franchise tax matters, and administrative tax controversies. Eric has extensive experience with unitary tax planning, business and nonbusiness issues, and entity structuring to manage multi-state tax liabilities.

Dave Anderton is a Managing Director in Seattle’s Commercial Practice group but also covers the Portland marketplace. He specializes in federal tax and provides advisory, compliance, and provision services to clients. Dave has 28 years of experience in tax consulting.
